The objective of study is to study “The Legal Relationship Between Doctor and Patient of Medical Service in Hospital”. The aims of the research are to figure out the moment of the contact between physicians and patients, the cause of conflict between physician and patients, and the quality of physicians and medical patients starts from the principle of vertical paternalistic. This causes a legal aspect of inspanningsverbintenis.
The methods used in this research are integrated approaches namely: doctrinal approach used to gain secondary data and non-doctrinal or sociolegal approach used to gain primary dara. The secondary data are analyzed with deductive method while the primary data are analyzed with inductive method. This research is carried out in Semarang Municipality.
Based on the analysis, the moment physicians and patients making contact is from the moment when patients consulting to the physicians and the physician agrees to cure the patients. The main causes of conflict between physicians and medical patients are because of (1) a gap between expectation and reality received by medical service user, (2) the different perception of relation pattern between physicians and patients, and (3) miscommunication between physicians and patients. Physicians responsibilities in providing medical service are including ethics, profession, and law covering physicians responsibility in criminal law, civil law, and administrative law.
